Your Membership Terms & Conditions
1. The Definitions
(a) Agreement means the Membership Agreement made between you and Red Line
(b) Billing Account means the bank account or credit card nominated by you to have your direct debit membership deducted from.
(c) Club means the Red Line club of which you are a member
(d) Club Rules mean the club rules as amended from time to time which are located within the club
(e) DD Membership means a weekly membership with a recurring fortnightly direct debit payments
(f) Dishonour Fee means a $10.00 fee
(g) Joining Fee means the $50.00 specified on the front page of the Membership Agreement and on our website
(h) Member means the individual who has entered into this Agreement with Red Line
(i) Membership Fees means the fees that are due and payable pursuant to this Agreement
(j) Members Tag means your membership card which allows access to the club and use of facilities as stipulated by your membership type.
(k) Minor means members under the age of 18
(l) Opening Hours means the hours of operation of the club and are located at the entrance way of the club and available from www.redlinefitness.co.nz
(m) Paid in Advance Membership (PIA) means members that have paid in advance according to the level of PIA membership as indicated on the front page of the Membership Agreement form
(n) Payment Agreement means the agreement between you and our Payment Provider, permitting the Payment Provider to provide the direct debit and credit card payment facilities
(o) Payment Provider means the Payment Provider specified by Red Line
(p) Policies means the Red Line Membership policies as amended from time to time, which are located at www.redlinefitness.co.nz and are available from your club
(q) Privacy Policy means the Red Line privacy Policy which is available from www.redlinefitness.co.nz
(r) Products means any products that are sold by Red Line
(s) Written Notice means notice in writing, given in person, email or post to the parties last known address or input of data via the Red Line website.
(t) Zones means the allocation of space in the Red Line club
(u) Zone Rules means the rules that specifically apply to each allocated space within the club a copy of which is available from www.redlinefitness.co.nz or from your club
2. Terms and Conditions
(a) Your membership at Red Line is governed by the membership agreement.
(b) The Agreement incorporates the terms of this Policy, the Club Rules and the Privacy Policy
(c) Signing the Membership Agreement does not automatically entitle you to a membership as your application may be subject to a further review to be undertaken by Red Line
3. Membership
(a) The nature of your membership permits you to use the Red Line premises, facilities, equipment and services as shown and limited by the membership identified. Your membership is non-transferable.
(b) Change of Details that are relevant to your membership must be provided to your Red Line Club in writing
(c) Membership holds are subject to satisfaction that you are eligible. Your membership must be in good standing with all membership fees current and can be put on hold for a minimum of seven days and a maximum of six weeks. All membership holds are subject to individual memberships and at club discretion.
(d) Membership refunds are available for Paid In Advance Memberships only. All fees must be in good standing and the refund is subject to the terms and conditions of the membership identified as per the Agreement.
(e) Membership cancelations are subject to 30 days written notice and the terms and conditions of the membership identified
4. Payments
(a) You agree to pay all Membership Fees as set out in the Agreement and agree to be bound by the direct debit terms and conditions as described in the Payment Agreement
(b) For a DD Membership you must make your payments on a fortnightly basis in advance
(c) For a PIA Membership you must pay your memberships in advance according to your level of PIA membership as indicated on the front of the Agreement
(d) For all Memberships the Joining Fee must be paid on signing this agreement and only cash or eftpos payments are accepted
(e) The Payment Agreement as completed on the Agreement authorises Red Line’s Payment Provider to debit the Membership Fee due for each direct debit from your billing account
(f) Red Line will endeavour to contact you over the phone, sms or email to inform you of any overdue payments.
(g) A member will be charged a Dishonour Fee of $10.00 in the event that a fortnightly direct debit payment is dishonoured
(h) A member will be charged $20 in the event that their membership tag is lost, stolen or damaged in anyway and requires replacement
(i) Additional fees will be the responsibility of the member in the event of bank charges or administrative charges incurred by the Payment Provider
(j) If there are repeated failures to meet your payment obligations (other than through the fault of Red Line or the Payment Provider) without prejudicing Red Line’s rights to recover any overdue payments, your membership may be suspended or terminated by written notice to you, including the acceptance of email to the last known address provided by the member
(k) Red Line reserves the right at any time to change the Membership Fees charged to members for use of the club facilities. Red Line agrees to use reasonable endeavours to provide you with written notice of the changes. The changes will take effect 30 days after the Written Notice has deemed to be received by you. We deem receipt to have occurred 2 business days after the Written Notice was issued. At the end of the 30 day notice period, you authorise Red Line and /or the Payment Provider to debit the revised amount from your account
5. Minimum Age
(a) All members of Red Line must be a minimum age of 16, however a minimum age of 12 subject to parental/guardian consent applies to the Combat Zone only. All minors must have a parent or guardian co-sign the Agreement
(b) All minors must comply with the restrictions of the Membership
(c) A suitably qualified instructor will provide all minors with a exercise program prior to commencement of exercise
6. Physical Condition
(a) It is your responsibility not to use any equipment or partake in any exercise which may adversely affect any medical condition
(b) You hereby represent to your Club, Red Line and their Directors, officers, employees, contractors and agents that to the best of your knowledge, you do not have any physical, medical or any other disability or condition which may be affected or aggravated by, or which may result in sickness, injury or death to you as a result of your use of the club and / or its facilities
(c) If you have any health or medical concerns now or after you join as a member of the Club, you must discuss them with your Doctor before using the equipment, Club or any of its facilities
(d) You acknowledge that Red Line did not give you any medical advice before you used the Club, its equipment or facilities and cannot give you any medical advice after you have used the Club its equipment and / or facilities
7. Video Surveillance
(a) For security purposes Red Line uses video surveillance equipment to monitor the club 24 hours per day
(b) Video surveillance is limited to the external entry way, reception area and club floor and is not within the walls of the bathrooms or assessment rooms
(c) By signing the Agreement you acknowledge that ba accessing Red Line you will be subject to video surveillance
8. Equipment
(a) You understand and acknowledge that Red Line purchases the equipment form a third party and therefore does not manufacture any of the fitness or other equipment within the club
(b) You understand and acknowledge that Red Line is providing recreational services and may not be held liable for defective products or equipment
9. Liability for Property
(a) Red Line is not liable to you for any personal property that is damaged, lost or stolen while in or around the Club, including but not limited to a vehicle or its contents or any property left in an open locker
10. Cooling Off Period
(a) All new memberships are subject to a 48 hour cooling off period
(b) A request for termination during the cooling off period must be made in writing and delivered to the club by post or email within the 48 hour cooling off period. An email will be deemed as received once acknowledged by the Club confirming termination
(c) For any memberships terminated under the Cooling Off period all funds Paid in Advance will be refunded to you by your Red Line Club, less an administration fee of $30.00. All refunds will be made within fourteen (14) business days from the date of termination
11. Termination or Suspension of Membership
(a) You may terminate your membership at any time in writing to your Red Line Club
(b) If your request for termination is due to sickness or physical incapacity a medical Certificate must accompany your written notice
(c) In the event of death your estate must provide written evidence in the form of a death certificate and all unused Membership Fees will be refunded
(d) If your request for termination is for reasons other than permanent sickness or physical incapacity, you may terminate your membership at any time, providing fourteen (14) days written notice. All fees during the fourteen (14) day notice period will continue to be deducted from your account. All refunds are subject to the membership being in good standing and subject to the terms of the membership identified. All refunds are processed by direct credit within seven (7) business days of the date of termination.
(e) In the event that fees are due in respect of your membership these will be deducted from any refunds due
(f) If you do not renew your PIA membership by the renewal date, your membership will automatically expire
(h) Red Line may suspend or terminate your membership at any time on the following basis;
(i) concern for your health and/or safety
(ii) non-compliance, improper or harmful conduct engaged in by the member
(iii) failure to make payment of membership fees
(iv) illegal activity within the club
(v) failure to comply with club rules and policies or violation of you agreement
(vi) improper behaviour or behaviour that maybe harmful to other members or the best interest of Red Line
(i) In the event Red Line terminates your membership, termination will be affective on the date that Red Line notifies of such action in writing.
(k) Upon termination of your membership by your election, you may continue to use the club for any period that you have paid in advance. You cease to have access to the Club once any period you have paid for in advance expires
(l) Termination or expiration of the Agreement shall be without prejudice to the rights of each party against the other in respect of anything done or omitted under this Agreement prior to such termination or expiration
12. Risk Warning
(a) Red Line warns that whilst you are on our premises using our club and recreational services, you are at risk of suffering physical harm or personal injury including broken bones, soft tissue injuries, permanent disability or death. These injuries may occur from you but not limited to;
(i) slipping on a wet floor
(ii) being struck by weights
(iii) colliding with equipment or other members
(iv) engaging in strenuous exercise and activities or
(v) incorrect use of equipment or Club
(b) You acknowledge that any such injury may result not only from your actions but from action, omission or negligence of others
(c) You acknowledge and agree that the above mentioned injuris and potential causes of injuries are not exhaustive and there are other known or anticipated risks that may result in injury, illness or death
(d) You acknowledge that whilst every attempt is made to ensure that the recreational services and facilities provided by Red Line are safe, there are some significant and inherent risks involved and you agree that you are participating voluntarily at your own risk and responsibility, thereby exposing yourself to certain risks
