How we deal with your Privacy
This Privacy Policy explains how The Red Line (NZ) Limited and its related companies (collectively referred to as “we”, “us” and “Red Line”) handle your personal information and how we comply with our privacy obligations.
We are subject to the Privacy Act 1993 (www.legislation.govt.nz) and understand and appreciate you may have concerns about your privacy and about the confidentiality and security of information that we may gain about you. At Red Line we are committed to protecting your privacy.
How and what information do we collect from you?
For the purposes of this Privacy Policy “Personal Information” is information from which your identity is apparent or can be reasonably ascertained. “Sensitive Information” is information about your health.
The types of Personal information generally collected by us includes your name, address, phone numbers and e-mail addresses, credit card or bank account details, occupation, your employer, date of birth and emergency contact details. Personal information is also collected when you provide business cards or other documentation to us containing such Personal Information, including when you complete a Membership Agreement and or Health Questionnaire. Personal Information also includes information we collect in the course of providing services to you and communications between you and us including but not limited to collection of IP address when visiting our website and from market research companies contracted by us to obtain information so that we may improve and market our products and services.
The types of Sensitive Information generally collected by us include information relating to your health and health related information that you provide on becoming a member and that is necessary to properly advise you about fitness activities or training.
As we are required by law to obtain your consent to the collection of “Personal” and “Sensitive” information, we will assume that you have consented to the collection of all information which is provided to us for use in accordance with this Privacy Policy.
How do we use the information provided?
In general we collect Personal Information for the following purposes;
(i) To process Membership Agreements and or any other related membership document
(ii) To manage and administer memberships
(iii) To facilitate access to our clubs by members, temporary members or casual visitors
(iv) To conduct marketing activities and marketing research
(v) To train staff and contracted fitness trainers
(vi) To communicate with members and visitors to our website
(vii) To respond to email and online enquiries
(viii) To communicate information and special offers to our members provided by us or third party approved providers
(ix) To operate The Red Line (NZ) Limited systems & procedures
Who do we share the information with?
We may disclose your Personal Information in a few different ways for example; to our third party contractors to whom we contract out certain services, Personal Trainers, data processing companies and direct debit service providers. Your Personal information will only ever be disclosed for the purpose for which the information was collected or for related purposes for example; to complete a transaction on your behalf, provide you with a service that you have requested or inform you about special promotions and offers which we believe may be of interest to you. All our contractors are subject to strict confidentiality obligations, which means that they are authorised only to use the Personal Information in order to provide the services or perform the functions required by us.
We will disclose Personal Information if we are required under a legal requirement to do so for example; under a court order or if an authorised request is made from a law enforcement agency or government for security, customs or immigration purposes.
Other than the above we will not disclose your Personal information without your consent unless disclosure is either necessary to prevent a threat to life or health, authorised or required by law, reasonably required to enforce the law or necessary to investigate a suspected unlawful activity.
Website Privacy
As we also collect Personal Information through www.redlinefitness.co.nz (“website’) this Privacy Policy also outlines our approach to online privacy issues and therefore it is to be read as forming part of the terms of use for our website.
Generally, all Personal information collected online will be handled consistently with Personal Information collected offline. Other matters specific to our handling or Personal Information online are set out below;
(i) Cookies
When you visit our website we will not collect any Personal Information unless you chose to provide it to us for example; sending emails through the website or signing up online. However, we may collect certain data that does not identify you when you visit certain pages such as your browser and operating system (“web log” information). We may also use “cookies” which are small files that are stored on your computer and that manage the security and navigation process of the site. You can choose to block these cookies but some portions of the site may not function correctly if you do. The type of data is collected for statistical purposes only and while cookies will identify your computer they are unlikely to identify you personally.
(ii) Email/SMS Marketing
We will not email or SMS you marketing material unless you have consented to this. This is a requirement of the Spam Act 2003. Further you can select to un-subscribe from our e-newsletter or other bulletins that we might elect to send out by using the “unsubscribe’ facility contained in each electronic publication we send.
(iii) Site Security Policy
Our website uses up-to-date technology to maximise the security of your Personal information.
What do you do if you don’t want our mail-outs?
In each e-mail or each piece of marketing material that you receive from us, we will endeavour to attach or provide simple instructions on how you can immediately unsubscribe from our mailing list. In any event you can opt out from receiving promotional material by contacting us and requesting to be removed from the mailing list. There is no fee due to us for any such deletion and our contact details are supplied below.
Access and Correction of your Personal Information
You can ask to obtain access to your Personal Information that we/and or our contractors hold, although under some circumstances permitted by law, we may not provide such information to you and /or may not be able to require our contractors to provide personal information to you.
We may recover from you reasonable costs of supplying you with access to this information. If we do intend to charge you we will notify you of this charge when we receive your request. Your request to provide access to this information will be dealt with in a reasonable time frame.
If we refuse to provide you access to this information, we will provide you with reasons for the refusal.
Is your Personal Information up to date?
We take all reasonable steps to ensure that your Personal information is accurate, complete and up-to-date whenever we collect or use it.
If the Personal Information we hold about you is inaccurate, incomplete or out-of-date, please contact us and we will take all reasonable steps to either correct this information, or if necessary, discuss alternative action with you.
If you fail to give us all the information we may require from you or the information you give us is inaccurate then the products, services and information we may provide to you may be affected.
Security
We use all reasonable endeavours to secure any Personal or Sensitive Information that we may hold about you and to keep this information accurate and up-to-date. We employ appropriate technical, administrative and physical procedures to protect your Personal Information from unauthorised disclosure, loss and misuse. To limit access to your Personal Information to those staff with a business to know and keep Personal Information only for as long as the law requires and to take all reasonable steps to comply with industry best-practice standards.
Subject to all applicable laws, we will take reasonable steps to destroy or permanently de-identify your Personal Information if it is no longer needed for that particular purpose for which it was originally collected.
Changes to this Privacy Policy
From time to time we may decide to amend or update this Policy. When this occurs, we will post any changes on the website. We therefore recommend that you review this policy periodically, so that you remain informed as to how we are protecting your Personal and Sensitive Information.
